The Tribunals Office is responsible for the administration of hearings by panels of the Discipline and Fitness to Practise Committees.

The Discipline Committee makes decisions about whether a member of the College committed professional misconduct or is incompetent.

The Fitness to Practise Committee makes decisions about whether a member is incapacitated.

The Discipline Committee and Fitness to Practise Committee also hear and consider applications from members who seek reinstatement after their certificate was revoked.

The Tribunals Office is separate from the investigations and prosecutions arms of the College and is not involved in the complaints process or in the decision to refer matters to the Discipline Committee or the Fitness to Practise Committee. The panels conducting the hearings are impartial and independent from the investigations and prosecutions arm of the College.

The Tribunals Office is also not responsible for overseeing any terms, conditions or limitations that may be imposed on the member’s certificate by the Discipline Committee or the Fitness to Practise Committee. These are overseen by the College’s Investigations and Professional Conduct Department.

About the hearings process

If a complaint has been investigated and is referred to the Discipline Committee, a Notice of Hearing which outlines the allegations to be addressed at the hearing is issued. A three-member panel made up of Ontario Certified Teachers (OCTs) in good standing and members of the public hears and decides the matter.

If the complaint is investigated and referred to the Fitness to Practise Committee, the matter proceeds to a hearing that is generally closed to the public.

Members can appeal the decision to the Divisional Court.
