The College is legally required to make every effort to provide timely hearings and fair treatment for our members. In the event a member is found guilty of professional misconduct, or to be incompetent or incapacitated, the member may appeal the Discipline Committee or Fitness to Practise Committee decision to Ontario’s Divisional Court.
Based on an appeal, the court may affirm, vary or reverse the original decision. Alternatively, it can also order a rehearing of the case. Appellants may request a certified copy of the record of the proceeding, including any documents received in evidence and the decision or order appealed from.
