1. Call to Order/Welcome

The Presiding Officer, Dave Bennett, called the meeting to order at 9:00 a.m. and welcomed all present.

He informed members that two placemats were available for members’ information:

  • The College’s Mission, Vision, Values and Strategic Priorities
  • College Council Parliamentary Procedural Tips

The Chair welcomed all Council members, staff and individuals in the public gallery to the meeting. On behalf of Council, she congratulated Jennifer Stewart and Shannon Marcus on their recent nuptials. She noted that Marie-Louise Chartrand and Robert Gagné are coming to the end of their terms, and thanked them for their service and commitment as Council members.

The Vice-Chair shared highlights of both Marie-Louise Chartrand and Robert Gagné’s careers and time on Council. She thanked both of them for their dedication to Council.

The Chair also noted that Michael Salvatori, Registrar and CEO, would not be in attendance. Joe Jamieson, Deputy Registrar would be providing the Registrar’s report and answering questions on his behalf. She also introduced Naomi Shopland and welcomed her to the role of Council and Committees Officer. 

Council member Anthony Samchek spoke about Orange Shirt Day on September 30, 2017 and presented a box of orange ribbons, to be distributed to Council members, members of staff, and members of the gallery, and to be worn in recognition of the ongoing commitment to reconciliation. He advised that orange shirts are worn to recognize the harm that was done to students in residential schools.

It was noted that Myreille Loubert and Robert Gagné comprised the Steering Committee.

2. Agenda and Approval of Preparation Time (GC20170927-57)

It was moved by Steering, and

That the Agenda for the September 27-28, 2017 Council meeting be approved. 

It was agreed that Council members would be entitled to a half day of preparation time.

4. Public Presentations 

4.1 Teaching in Catholic Schools Program

Michael Pautler and Michael O’Keefe made a presentation on the Teaching in Catholic Schools Program.

A question and answer session followed the presentation.

The Presiding Officer thanked Michael Pautler and Michael O’Keefe for their presentation.

5.1 Meeting, June 6-7, 2017 (GC20170927-58)

The Minutes of the Council Meeting held on June 6-7, 2017 were approved by unanimous consent.

6. Business Arising

There were no business arising items.

7. Registrar’s Report (GC20170927-60)

The Registrar’s Report was received. The Deputy Registrar spoke to the report and responded to questions.

He highlighted the following:

  • Initial regulatory development is continuing with a cross-College work group focused on several provisions under the Protecting Students Act.
  • A status update on the removal of discipline decisions from the College website.
  • In response to the Ontario Ministry of Government and Consumer Services launching a policy recognizing “X” as a non-binary gender identification for individuals who do not identify as either male or female, the College is considering providing a third, non-binary option for gender identification on the College’s online application form and the Members’ Area.
  • Update on various College-wide initiatives to support the four Strategic Priorities.
  • A status update on the professional advisory on bullying.

The Deputy Registrar also shared that Michael Salvatori is the new president elect for Council on Licensure Enforcement and Regulation (CLEAR).

7.1 Financial Report as July 31, 2017 (GC20170927-61)

The Ontario College of Teachers’ Financial Report as at July 31, 2017 was received. The Controller, Fred Towers, spoke to the report and answered questions.

8. Chair’s Report

8.1 Report (GC20170927-62)

The Chair’s Report was received. The Chair, Angela De Palma, spoke to her report and responded to questions.

She highlighted:

  • The College’s summer Focus Group sessions.
  • An outline of various outreach activities across the province.
  • Her attendance at various committee meetings.
  • Recent communication to the Minister of Education drawing attention to the outstanding appointed member position on Council arising from the conclusion of member terms.
  • The development of a succession plan, which will be shared with the next Chair of Council including input from the Vice-Chair and the Registrar.

8.2 Registrar’s Performance Appraisal (In Camera) (GC20170927-63C)

11.1 Amendments to the Teachers’ Qualifications Regulation re: inclusion of technological qualifications for initial certification on certificates of qualification and registration (GC20170927-77)

The Briefing Note on amendments to the Teachers’ Qualifications Regulation was received and Linda Zaks Walker, Director of Membership Services spoke to the topic and answered questions.

It was moved by Steering, and

CARRIED,

That Council recommend to the Minister of Education that the College’s Teachers’ Qualifications Regulation be amended by addition in Section 1 and section 19 (1) in order to reflect initial technological qualifications on a certificate of qualification and registration as follows:

  • 1(1) “acceptable diploma or advanced diploma” means the diploma that is granted by a post-secondary educational institution authorized to grant the diploma under theOntario Colleges of Applied Arts and Technology Act, 2002 or a predecessor Act, or under the Private Career Colleges Act, 2005 or predecessor Act, or by another institution acceptable to the College
  • 19 (1) Every general or transitional certificate of qualification and registration shall be issued in the form prescribed by the by-laws, and shall indicate,

(…)

(e) all acceptable certificates, diplomas or advanced diplomas granted to the applicant at the time of certification related to their technological education qualifications;

(f) all acceptable work experience and competence demonstrated by the applicant at the time of certification related to their technological education qualifications;

11.2 Amendments to Regulation 437/97 – Change name of Child and Family Services Act to Child, Youth and family Services Act (GC20170927-78)

The Briefing Note on the amendments to Regulation 437/97 was received and Joe Jamieson, Deputy Registrar spoke to the topic and answered questions.

Regulation 437/97 – Professional Misconduct

That Council recommend to the Minister of Education that clause 27 of section 1 of the Regulation 437/97 – Professional Misconduct be amended to substitute the reference to the Child and Family Services Act with the Child, Youth and Family Services Act, 2017, with the amendment to become effective on the day the Child, Youth and Family Services Act, 2017 comes into force.

Ontario College of Teachers Act

That Council recommend to the Minister of Education that the following amendments be made to the Ontario College of Teachers Act: (1) subsection 29.1(1) be amended to substitute the reference to section 72 the Child and Family Services Act with a reference to section 125 of the Child, Youth and Family Services Act, 2017  and (2) that clause 24.1 at subsection 40(1) be amended to substitute the reference to the Child and Family Services Act with the Child, Youth and Family Services Act, 2017, with the amendments in (1) and (2) to become effective on the day the Child, Youth and Family Services Act, 2017 comes into force.

Council members discussed the current Council Member Laptop Policy as it was considered by the Executive Committee meeting at their last meeting. It was noted that a two-thirds vote was required to pass a motion to amend the current policy.

If the same laptop has been assigned to an elected member for a full three-year term of Council, or in the case of an appointed member, equivalent to three consecutive years of service, the laptop will be provided to the member for a nominal value of $100. Laptops that have been deployed for periods of less than three years (due to the member's length of service, replacement due to theft, damage or functionality) will be valued by College IT staff at the time and will reflect current market value. Should the Council member opt to purchase the laptop, the College's software will be uninstalled as our licenses do not permit their resale.

12. Notices of Motion

The following Notices of Motion was read into the Minutes for consideration at the December 7-8, 2017 Council Meeting

12.1 Amendments to Section 24 of the College Bylaw re: removal of name history on the College public register – gender identity (GC20170927-80)

Moved by Steering:

That Council replace section 24.05 of the College’s by-laws with the following clause:

24.05 Notwithstanding anything in the Act, regulations or bylaws, the Registrar may permit a different name or former name to appear on the Register, upon the request of the member when:

1) it is necessary for personal safety;

2) the former name is inconsistent with the gender identity of the member

Where a member requests the removal of a name or a former name, the member shall provide the Registrar with a written request which includes evidence satisfactory to the Registrar to confirm the basis for the request.

12.2 Amendments to Section 25 of the College Bylaws re: technological qualifications for initial certifications on certificate of qualifications and registration

Moved by Steering:

That Council replace section 25.01 of the College’s by-laws with the following clause:

25.01 In addition to the information prescribed by section 23 of the Act, the register shall contain:

(…)

  1. any certificate, diploma or advanced diploma granted to the applicant at the time of certification related to their technological education qualifications;

  1. any acceptable work experience and competence demonstrated by the applicant at the time of certification related to their technological education qualifications;
