1. Call to Order/Welcome
The Presiding Officer, Lori Lukinuk, called the meeting to order at 1:00
p.m. and welcomed all present.
The Chair welcomed and introduced Jacqueline Karsemeyer to the meeting and
noted that she had been appointed to Council effective July 1, 2016
replacing Terry Price. She also welcomed and introduced Pier-Olivier
Arsenault, and noted that he would be replacing Irene Cheung on Council.
It was noted that Marie-Louise Chartrand and Myreille Loubert comprised the
Steering Committee.
2. Agenda and Approval of Preparation Time
(GC20160929-67, revised)
It was moved by Steering, and
CARRIED,
That the revised Agenda for the September 29-30, 2016 Council meeting be
approved.
It was agreed that Council members would be entitled to one full day of
preparation time.
3. Conflict of Interest
Ravi Vethamany declared a conflict with the motion related to the
realignment of positions in the Governance Committee Report.
4. New Business
4.1 Appointment of Southeast Region Full-time Member
(GC20160929-94)
The Registrar advised Council that the elected Southeast Region Full-Time
position became vacant when Irene Cheung resigned her position on Council
effective
September 1, 2016. He advised that Pier-Olivier Arsenault was the runner up
in this category in the 2015 Council election and is eligible and
interested in serving in the position for the balance of the term of the
seventh Council.

That Council appoint Pier-Olivier Arsenault, OCT to fill the Council
vacancy in the
Southeast Region Full-Time position, effective September 29, 2016.

The Minutes of the Council Meeting held on June 2-3, 2016 were approved by
unanimous consent.

. Business Arising
7.1 Bill 200, Protecting Students Act, 2016 - Issues requiring Council
direction
(GC20160929-70, revised)
The paper on Bill 200, Protecting Students Act, 2016 - Issues
requiring Council direction was received. The Registrar noted that Council
member inquiries had been reviewed following the introduction of Bill 200
and that the College had met with Ministry staff with respect to policy
questions that required clarification. He advised that the paper
highlighted a number of priorities for Council's direction.
The Director of Investigation and Hearings, Chantal Bélisle, spoke to
the definition of spouse and noted that the College believed that the
spousal exemptions in Bill 200 should be deleted or should be amended to
make clear the circumstances in which it would be applied.
A question and answer session ensued.
It was moved by Steering, "
That Council recommend that the Minister of Education amend Bill 200 by
deleting the spousal exemption or alternatively that the spousal
exemption be limited to situations in which the student is an adult and
the member is an instructor in adult education."
It was moved by Colleen Landers, seconded by Richard Michaud, and
CARRIED,
That Council amend the above motion by the deletion of the words: "or
alternatively that the spousal exemption be limited to situations in
which the student is an adult and the member is an instructor in adult
education", from the sentence, to read:
That Council recommend that the Minister of Education amend Bill 200 by
deleting the spousal exemption.

The Director of Corporate and Council Services, Richard Lewko, spoke to the
matter of removal of information from the register and noted that the
College believes Bill 200 should be amended to ensure that all discipline
decisions remain on the College's website regardless of whether the
corresponding notation remains on the public register.

The Director of Corporate and Council Services stated that the College
believed that there should be two exceptions where a notation on the public
register should not be linked to a decision in the College's decision
database: (1) where the allegations have been withdrawn due to, for
example, insufficient evidence to proceed to a hearing, and (2) where the
member has been found not guilty of professional misconduct or not to be
incompetent, unless requested by the member.

That Council recommend that the Minister of Education amend Bill 200 so
that in cases where the allegations have been withdrawn, and where the

The Director of Corporate and Council Services spoke to the need to amend
Bill 200 in order to give the College discretion to post explicit terms,
conditions and limitations from sensitive Fitness to Practice decisions on
the public register.

The Director of Investigation and Hearings spoke to the use of prior
decisions at the Investigation and Discipline Committee stages. She noted
that the College believes the proposed statutory provisions in Bill 200
should be amended to provide a direct reference to the use of prior
decisions, information about or obtained in concurrent proceedings and
resolutions reached through the Complaint Resolution process at the
Discipline Committee stage as well as at the Investigation Committee stage
and that the Investigation Committee would not be required to review any
prior decision where the outcome was a "refusal to consider and investigate
a complaint" at the conflict resolution stage.

8.1 Report of the Public Interest Committee
(Timed Item: Thursday, September 29, 2016 at 3:00 p.m.)
Bill Kirkwood, Chair of the Public Interest Committee, provided a verbal
report of the Public Interest Committee meeting on September 19, 2016. He
noted that the committee had reviewed the assessment of the CBC Marketplace
Story. In addition, the committee had been provided with an overview of
Bill 200 and the public register transparency initiatives undertaken by the
Regulated Health professions. The committee had also received an update on
its four recommendations to Council.
The Chair of the Public Interest Committee advised Council that one of its
members would be resigning from the committee and in so doing the committee
would no longer have quorum. Consequently, the committee has petitioned the
Minister of Education to increase the membership of the committee to five
members.

the amendment would reflect current practice at the College.

The Director of Investigation and Hearings noted that the paper had been
revised to include the matter of the school board as a complainant. She
noted that the College believes the proposed statutory provisions in Bill
200 should be amended so that employers continue to
"report" to the College rather than serve as a "complainant."

9.2 Duty to Report - Attestation
(GC20160929-71)
The Duty to Report Attestation - Council Options was received. The
Registrar advised that this topic was being considered as a result of one
of the Baldwin Inquest recommendations to the Government of Ontario to
direct regulatory bodies overseeing certain professions to review their
practices regarding promotion of the duty to report and ensure that the
legal obligations of professionals are given adequate attention.
The Registrar provided information on the feedback he had received from
stakeholder and member consultations related to the topic of an annual
attestation on the duty to report and compliance measures. He advised that
the College had also conducted research into the attestations implemented
and compliance measures by other regulators and school boards.
The options on the duty to attest were reviewed.
After a lengthy discussion on the matter the Presiding Officer noted that
it would be expedient to deal with option 3 first: That Council approve
option #3 - No Attestation.
The Professional Advisory on the Duty to Report will be used to advise
members of their duty to report obligations.
It was agreed to resume discussion of this matter the following day.

The Chair brought to the attention of Council members that September 30 th has been declared "Orange Shirt Day". She noted that it
was so-called to recognize that every child matters. She advised
Council members that she had bought "every child matters" buttons, on
behalf of Council, to be distributed to members, and to be worn in
recognition of the ongoing commitment to reconciliation. She advised
that orange shirts are worn to recognize the harm that was done to
students in residential schools and to show a commitment to the
principle that every child matters. The Chair asked
Jennifer Stewart, who was wearing an orange shirt, for any additional
comments. Jennifer Stewart advised that orange t-shirts could be
purchased from her.

The Registrar noted that at the June 2-3, 2016 meeting Council agreed to
postpone consideration of the publication of the College's full Discipline
Committee decisions involving incompetence and the publication of summaries
of discipline decisions involving incompetence to the September 29-30, 2016
Council meeting so that the recommendations could be assessed with
reference to the information contained in
Bill 200, Protecting Students Act, 2016.

That Council recommend that the College provide full text Discipline
Committee decisions to the legal database CanLII."
It was moved by Robert Ryan, Chair of the Investigation Committee, "
That Council amend the motion by the addition of the following words
"for a period not exceeding three years", at the end of the sentence,

12.3 Governance Committee

The report of the Governance Committee was received. The Chair, Matthew
Kavanagh, spoke to the report. He referred members to the self-assessment
tool for Council evaluation purposes and advised that the committee had
agreed to pilot an individual meeting assessment tool for the September and
December Council meetings. He advised Council members that they would
receive a link to the online evaluation tool following the meeting and
requested that members complete the questionnaire.
He advised that over the past year the committee had reviewed possible
amendments primarily to the election regulation, based on issues that came
to light during the 2015 election, and some are proposed by the committee
to improve member participation. He noted that there were five distinct
areas where amendments were being proposed.
The Presiding Officer noted that each of the recommendations would be
considered separately before proceeding to the next item.
Richard Lewko, Director of Corporate and Council Services, reviewed each of
the five specific areas where recommendations were proposed and provided
rationale for the amendments to the Election Regulation.

That Council request that the Minister of Education amend the Election

13.1 College Bylaws: Proposed Amendments to Section 7 - Committee Chair
Vacancy Process

The Registrar reminded Council members that at its June 2-3, 2016 meeting,
a notice of motion was read into the Minutes for consideration at the
September Council meeting which confirms that the selection of a chair of a
committee should take place following a vacancy rather than prior to one
occurring.
It was moved by Matthew Kavanagh, Chair of the Governance Committee, and
CARRIED,
That Council amend the College bylaws by addition of the following:
7.07 If the chair position of a statutory, regulatory, standing,
special or ad hoc committee becomes vacant, the Council shall, as soon
as reasonably possible, appoint a chair from among the members
appointed to the committee.
And renumber the remaining sections accordingly.

13.2 Appointment of Presiding Officers

The Registrar noted that a roster of presiding officers was still in
development and requested that this matter be deferred to a future meeting
of Council.
It was moved by Michael Salvatori, seconded by Myreille Loubert, and
CARRIED,
That Council postpone consideration of the following motion to a future
meeting of Council:
That Council appoint Lori Lukinuk and Jim Dunsdon as Presiding Officers
for the term of the Seventh Council of the Ontario College of Teachers
effective September 29, 2016.

the Register

The following Notice of Motion was read into the Minutes for consideration
at the
December 1-2, 2016 Council Meeting:
Moved by Steering:
That Council approve that section 25.01 of the bylaws of the Ontario
College of Teachers be amended by adding the following sub-section (g) to
read as follows:
25.01
In addition to the information prescribed by section 23 of the Act, the
register shall contain:
(g) any undergraduate, graduate or post-graduate degree granted to a
member, with the name of the post-secondary educational institution
authorized to grant the degree, and the date the member completed the
degree.
The current subsections 25.01(g)-(i) would be renumbered as required.
Jim Dunsdon assumed the role of Presiding Officer.
15. Registrar's Report
15.1 Report

The Registrar's Report was received. The Registrar spoke to his report and
responded to questions.
The Registrar advised that he had received an email notification in the
past couple of hours from the Ontario Ombudsman in which it was reported
that the Ombudsman had received 859 complaints about school boards during
the past year. He advised members that he would be following up on this
matter and would provide more details once he had received additional
information.
15.2 Financial Report as July 31, 2016

received. The Deputy Registrar, Joe Jamieson, spoke to the report.
