College members facing allegations of professional misconduct have a right to expect timely hearings and fair treatment. If they are found guilty, they may appeal the Discipline Committee decision to Ontario’s Divisional Court.
Appeals may be made on questions of law, fact or both and the court may affirm, rescind or rehear the matter in whole or in part. Appellants may request a copy of the record of the original proceeding, any evidence, and the decision or orders.
Investigation and Executive Committee decisions or those of the Council and Registrar may not be appealed. However, a party can seek a judicial review to determine if a panel has exceeded its jurisdiction, committed an error of law or breached the rules of natural justice.
